Terms of Service
These Terms of Service (“Terms”) apply to your use of builtbyendless.com (the “Site”), operated by Endless Consulting, LLC (“Endless,” “we,” “us”), and to text messages you receive from us. By using the Site or opting in to our text messages, you agree to these Terms. If you do not agree, please do not use the Site.
1. Using the Site
You may use the Site to learn about Endless, send us an inquiry, and apply to work with us. You agree not to:
- use the Site for any unlawful purpose;
- submit false or misleading information, or information you do not have the right to share;
- interfere with the Site’s operation or security, or attempt to access areas you are not authorized to use;
- copy, scrape or reuse Site content for commercial purposes without our written permission.
2. Inquiries and applications
Sending an inquiry or an application through the Site does not create a contract, a client relationship or an offer of employment. Any services we provide are governed by a separate written agreement between you and Endless.
3. Text messaging terms
Endless Consulting offers text messaging to people who have given us their mobile number and agreed to be contacted by text.
- What we send. Replies to your inquiry, event and vendor coordination, scheduling and service updates. We send marketing or promotional texts only if you have separately agreed to receive them.
- How you opt in. By providing your phone number through our contact form, by texting us first, or by giving us your consent verbally or in writing.
- Frequency. Message frequency varies.
- Cost. Message and data rates may apply.
- Opt out. Reply STOP at any time. We will confirm, and you will receive no further messages unless you opt in again.
- Help. Reply HELP, or email Info@builtbyendless.com.
- Not required. Consent to receive text messages is not a condition of purchasing any goods or services.
- Delivery. Mobile carriers are not liable for delayed or undelivered messages.
Our Privacy Policy explains how we handle your phone number and messaging consent. We do not sell or share them with third parties or affiliates for marketing or lead generation purposes.
4. Intellectual property
The Site and its content, including the Endless name, logos, text, images, video and design, are owned by Endless or its licensors and are protected by law. Other names and marks shown on the Site belong to their respective owners.
5. Other sites and services
The Site links to sites and services we do not control. We are not responsible for their content or practices. Separate portals we operate, such as vendor login, may have their own terms.
6. Disclaimers
The Site is provided “as is” and “as available.” To the fullest extent permitted by law, Endless disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. Information on the Site is general and may change without notice.
7. Limitation of liability
To the fullest extent permitted by law, Endless will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, revenue or data, arising from your use of the Site or our text messages.
8. Governing law
These Terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to its conflict of laws rules.
9. Changes to these Terms
We may update these Terms from time to time. When we do, we will post the updated version on this page and change the effective date above. Your continued use of the Site after a change means you accept the updated Terms.
